Viralee Scam update- the lawyer letter

Just when I think “Gosh.. I gotta really work my brain to come up with something to blog about today,” scammer Dominic Holland from Viralee sends me a legal threat. I shall share it, and of course provide feedback… in RED! ’cause that’s what they do in the American school system to ruin kids’ dreams and hopes, and I want to crush Dominic Holland’s hopes of scamming people. And now… the letter:
Dear Ori,
Please be advised that if every public reference you have made to both myself being a ‘scammer’ and Viralee being a ‘scam’ be removed, and a public withdrawal of comments then I will be suing on the basis of Defamation of character. This is not a joke and I am offering 24 hours for this to happen or you will be contacted by my attorney’s who will begin proceedings.
Notice that his grammar is incorrect. By his incorrect use of the English language, he is actually telling me that if I remove my scam warnings from the web, then he will be suing. Most people that have issues like this ask you to remove them…. but not Dominic Holland of Viralee, he will only sue if you remove them. Perhaps he believes in the whole “No publicity is bad publicity” thing? It has been more than 24 hours, I did not remove any of my warnings, and I have not heard from an attorney. Hint, if the attorney has an email from Domsnetwork.com… I probably won’t be too scared.
There is absolutely nothing to support or warrant your claims. My company is a reputable company and provides a reputable service. Paypal had frozen the funds for your order and hence the order was not fulfilled. We replied to every email that came through to us from you. You requested a refund and received one.
There is nothing to support my claims… except the fact that no service was provided within the slightly over a month period, and no replies. Oh yeah… and the fact I kept every e-mail that I sent and received. I received a reply to my e-mail on the 7th. I did not receive any to the ones I wrote on 12/9, 12/13, 12/20, 12/30, or any of the ones in January (including the dispute ones through Paypal). Those were by e-mail. I also tried on 12/23 through Facebook. Paypal had frozen the funds for my order after 30 days, when I disputed the charge… but before I escalated it to a scam. I received a refund because Paypal took the money from Viralee, and gave it back to me. This was not a voluntary action on Viralee’s behalf. In fact- here’s their letter (I’ll make it a different color, ’cause Paypal, unlike Viralee, did not try to keep my money, then pretend they were trying to give it back to me)- Letter sent to me on 1/16/2010

Dude! Seriously? You just tried to steal from me, and lie to me about it, and you think I’d be dumb enough to give you access to my Facebook Fanpage? No friggin way! And definitely not at “Your cost” – I don’t want it free, and I sure as hell ain’t giving you whatever “cost” is. Oh yeah… and since Paypal had to be the ones to give me the funds, and not you, I do consider you a scammer. So far I’ve got a few other people that have requested refunds (since you did not deliver what Viralee promised), and have either received nothing, or have had to sue. Check it out for yourself Dominic Holland, there was just a new comment posted today about Viralee being a scam!

Now I will write in black, ’cause that red was (is) annoying, and I’m not directing my reply at scammers like Dominic Holland, but rather, at you dear reader.

That was cut/paste from their site— I think it’s been about 3 days, so … clearly that too is another lie from them. Read the fine print: * 7 Day Guarantee only applies when a 7 day rushed plan was purchased, otherwise 30 day guarantee applies.
Many of my attorney friends made a very good point. I have documentation of everything, Paypal vindicated me, and… I’m a couch surfer! I travel everywhere… so the hell will this guy (who lives in Australia) get to serve me a court summons? Though, I’ve had many attorneys step up and tell me they got my back should I need one against this poor excuse for a human being.

Wow dude, sounds like a big pain in the a**. I believe you're in the right and Dominic is clearly in the wrong. Will be interesting to see how this turns out and if it just stops here.

Amazing. And I love how he's actually making it worse for himself. If he was legit, he would have commented on your blog post to debate the issue, or wrote his own blog post re why you are wrong w/ a bunch of evidence. But no, he sends a (lame) threatening email to try to intimidate you. (as if.)
As a non-stupid lawyer, I always enjoy when lame people threaten legal action on total b.s. … of course, that's also b/c I would think defending such a lawsuit would be highly entertaining. Let me know if he serves you (99.999% sure he doesn't have the guts), that would be fun.

Dear Ori,
I am intrigued. After browsing your site, you seem to make note of your professional achievements:
“I’m an award winning photographer, a marketer, a videographer / video editor… a problem solver”.
In fact, if we listen to you, your business sense must be incredible…
'I’ve gotten to…help businesses', and if we're lucky, you'll, 'teach some useful business/marketing techniques'. Your headline is even about, 'bringing success to your door'.
But after browsing through those parts of the site, I came to this one:

Now I'm just plain confused. Because when I read earlier, I thought you were a successful businessman. But now, I'm starting to think you need some money because you can't afford to pay your bills – or eat. I'm copied from that page:
“Going around the country uses up a lot of gas…. There are other costs involved too, such as video tapes, FOOD, insurance, all that fun stuff.”
As i've noted elsewhere on the site, I have always thought it unlikely that you can afford to live from your photography, but it appears your other business ventures aren't doing terribly well either.
Once again, I would have you consider that you are in fact a fairly unmarketable product (judging from your work and your need for hand outs from strangers), and it is not the service (Viralee) but actually the product (you) that is lacking.

Dear John,
I am glad that my site intrigues you.
The donate button was added when the site was started (2006). I have not changed the prices or the text. It has been a favorite for radio DJ's to talk about when interviewing me. People seem to get a kick out of the massage with a 20 gas tank purchase (I'm sure you're dying to point out that I have yet to get such a large donation (although, I did have someone message me that they are saving to be the 1st one)).
I appreciate your perspective. I never really thought about how having a donation page can reflect poorly on my business acumen. I may remove it… although the novelty is there, and some of the old replays of interviews will still mention it. This really gives me something to think about.
If my business is faltering so badly that I can't even afford to eat (and you can check with my friends… I consume massive quantitites), but I give the last of my funds to Viralee, then Mr. Holland should be even more ashamed of himself! He should at least have the decency to only bamboozle individuals that have the funds for basic necessities of life, no?

By the way, I think John Falkes is a pen name for a guy we all know by the name of Dominic Holland. Why else would he talk so highly of a con artist and so lowly of someone who provides a real service? And then on top of that, not provide a link to his site. I can't even find the name John Falkes on Google. Good try man, but your words are empty here.

I am not Dominic Holland, however I applaud your ability to leap to obvious conclusions. I think this, at least, is clear from my grammar, and his.
I await a reply from Ori, one from you is unnecessary at this juncture.

There is an obvious difference between you simply berating Ori and Ori pointing out that he and others were blatantly ripped off. If you can't see that, then you have much bigger problems than this Viralee thing. And I don't care if it's necessary or not to you, I'll be the judge of what public forums I participate in.
And ok, you probably aren't Dominic, but that still doesn't explain why you are defending him with such veracity. Also, I would love to see some of your work. Can you tell me where I can find it because you a ghost on the internet?
